1. Acceptance
By accessing thatphotoguy.com or engaging us for photography services, you accept these terms. If you do not accept them, do not use the site or book a session.
2. Services
ThatPhotoGuy provides editorial photography services including but not limited to headshots, brand photography, real estate photography, product photography, event coverage, and commercial campaigns. The specific scope of any engagement is documented in writing prior to the shoot.
3. Pricing and Payment
Pricing is published on the pricing page and confirmed in writing before any session. A 50 percent deposit is required to lock the date. The remaining balance is invoiced at delivery. Sessions under 500 dollars may be paid in full at booking. Accepted payment methods include credit card, Zelle, Venmo, and Cash App.
4. Cancellation and Reschedule
Reschedules are free with at least 7 days notice. Cancellations more than 14 days out receive a full refund of any deposit paid. Cancellations within 14 days forfeit the deposit. Weather reschedules for outdoor shoots are always free regardless of timing.
5. Delivery
Standard turnaround times are 5 business days for headshots, 48 hours for real estate, and 10 business days for brand, event, and commercial work. Delivered files are made available through a private password protected gallery. The gallery remains accessible for 90 days after delivery.
6. Image Rights and Licensing
ThatPhotoGuy retains copyright on all delivered images. The client receives the licensing scope specified in their package. Personal sessions include full personal use rights. Business sessions include standard commercial use rights for the photographed business across web, social media, print marketing, email, and trade show display. Extended uses including out of home advertising, paid social spend over 10,000 dollars annually, or stock licensing require additional licensing.
Raw files are not delivered as part of standard packages. Raw file licensing is available for an additional fee on a project basis.
7. Portfolio Use
ThatPhotoGuy reserves the right to feature delivered work in our portfolio, marketing materials, and social media unless the client opts out at the time of booking. Private portrait and family sessions are not used in portfolio without explicit written consent.
8. Revisions
Standard packages include one round of revisions on up to five images. Additional retouching is billed at 75 dollars per image. Brand and commercial packages have revision allowances built into the deliverable count.
9. Liability
ThatPhotoGuy carries professional liability insurance. In the event of equipment failure, illness, or other circumstances beyond our control that prevent delivery, our liability is limited to refund of any payments made. We are not liable for consequential damages.
10. Force Majeure
Neither party is liable for failure to perform due to causes beyond their reasonable control including but not limited to weather, natural disaster, illness, government action, or acts of war.
11. Governing Law
These terms are governed by the laws of the State of Missouri. Any dispute will be resolved in the courts of Barry County, Missouri.
